Despite the best efforts of the BBC it had become one of the worst-kept secrets in television.

And The Stig's identity was confirmed yesterday as the Beeb had its day in court to try to stop him publishing an autobiography.

As revealed last month, the man behind the mask is racing driver and former member of the military Ben Collins.

The 35-year-old served as a member of the renowned 23 SAS, the regiment of highly-trained reservists. There he acted as a driving instructor, helping develop high-speed escape and evade tactics for fellow members.

In one last vain effort to stop the Top Gear driver's identity being revealed, the BBC had asked that the hearing at London's High Court be held in private.

But television bosses could not do anything to block the public arrival and departure of Mr Collins at court yesterday.

Asked if he had brought his trademark helmet with him as he arrived at court yesterday, Mr Collins said: 'You're trying to get me to say something I shouldn't.'

Pressed on whether his presence at court could be read to mean he was The Stig, he gave a polite 'No comment'.

As expected, the corporation failed in its attempt to get an injunction preventing publication of The Stig's autobiography.

However, after the hearing the BBC was still refusing to name the man behind the mask.

And while Mr Collins won the right to tell his story, he appears to have lost his spot in the Top Gear limelight with chiefs expecting to wield the axe.

After the judge ruled in favour of the book, publishers Harper Collins confirmed The Stig had been in court.

They said in a statement: 'This is a victory for freedom of speech.

Ben Collins has a great story to tell about his seven years as The Stig which will appeal to a wide audience beyond the world of motoring enthusiasts. The book, titled The Man in the White Suit, will be published on September 16.

The racer left court shortly before lunch to return to Bristol, where his wife Georgina has just given birth to their third child - a boy called Cassius.
