He's been held in the western town of Zintan since his arrest last November. Both the ICC and the Libyan authorities want to put him on trial for his role in attempting to suppress the uprising which led to the overthrow of the former Libyan leader. A Libyan lawyer dealing with the case, Ahmed al-Jehani, explained by one of the members of the ICC delegation Melinda Taylor have been detained.
"During her visit, this lady tried to pass certain documents to him, handwritten documents and to get him to sign other blank documents. The documents were from certain people outside the country including Mohammed Ismail, his former head of bureau. These documents were confiscated and as the prosecutor happened to be present, the matter was referred to him."
Mr Jehani also claimed the ICC delegation tried to bring a camera and a tape recorder to their meeting with Saif al-Islam.
"The delegation's bags were searched for security reasons which is routine for entry to the place of detention. And it was discovered that this lady had a camera in the form of a pen and the other lady had a recording device in the form of a watch. All this equipment was confiscated by the prosecutor who is still investigating the matter. And Ms Taylor, the lawyer, remains at the guesthouse.
